Operator Identity
BenchmarkHQ is a product built by Eugene C. Posniewski and operated by Dynakai Industries LLC.
Payments are processed by Polsia on behalf of Dynakai Industries LLC. Polsia is the merchant of record and appears on your payment statements and receipts. Refund requests and billing disputes are handled by Polsia.

Eligibility
BenchmarkHQ is intended for use by adults (18 years of age or older) and business users. By creating an account, you represent that you are at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization.
Acceptance of Terms
By creating an account or subscribing to BenchmarkHQ, you agree to these Terms of Service. If you do not agree, do not use the service.
Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, for material changes, provide advance notice by email or through the service before the change takes effect. If you do not agree to a material change, you may cancel your subscription before the effective date. Material changes apply prospectively from their effective date. Nothing in these Terms limits rights or remedies that cannot be waived under applicable law.
Membership, Billing, and Auto-Renewal
Membership plans are offered on a monthly or annual basis, as selected at checkout. Subscriptions renew automatically at the end of each billing period unless canceled before renewal. By subscribing, you authorize recurring charges to your selected payment method until you cancel. Billing is processed by Polsia as merchant of record on behalf of Dynakai Industries LLC, and Polsia may appear on your payment statement.
Prices are listed in USD. Any applicable taxes will be shown at checkout. If any separate checkout fee applies, it will be disclosed clearly before you complete your purchase.
We provide the automatic-renewal terms, billing frequency, price, and cancellation method at checkout and in a confirmation you can retain. If you subscribed online, you can cancel online from your account dashboard at any time. Where required by applicable law, we will also provide renewal reminders, material-change notices, and fee-change notices with cancellation information.
Cancellation vs. Account Deletion
These are two separate actions:
- Cancel your subscription — Stops automatic renewal. Your access continues through the end of the current paid billing period. You can cancel from your account dashboard at any time.
- Delete your account — Permanently removes your account and associated data. This is a separate request and must be submitted by emailing support@benchmarkhqdata.com. Account deletion does not automatically trigger a refund.
Canceling your subscription does not delete your account. Deleting your account does not guarantee a refund for any remaining subscription period.
Refund Policy
Except as required by applicable law or by Polsia's merchant-of-record obligations, subscription fees are non-refundable once the applicable subscription term begins and access has been granted. If you cancel, your access continues through the end of the current paid billing period. Requests involving billing errors, duplicate charges, or exceptional circumstances may be reviewed by Polsia and Dynakai Industries LLC.
Content License
Your membership grants you a license for internal business use to access and use BenchmarkHQ reports and analysis. This license explicitly permits:
- Internal business planning and budgeting
- Board decks and investor updates
- Internal team sharing within your organization
- Strategic planning and internal reporting
This license does not permit:
- Reselling or commercially licensing our content to third parties
- Public redistribution or reposting of raw report content
- Creating competing commercial data products from our content
- Sharing account credentials with people outside your organization
Licenses are non-transferable and may not be sublicensed.
Data Accuracy
BenchmarkHQ content reflects BenchmarkHQ's independent analysis of publicly available industry materials and is provided for informational purposes only. Although we use reasonable efforts to maintain the service, we do not guarantee that any benchmark, report, export, or output is complete, accurate, or fit for a particular purpose. You remain responsible for your own business, financial, and operating decisions.
Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you suspect unauthorized access, notify us immediately at support@benchmarkhqdata.com. We are not liable for losses resulting from unauthorized use of your account due to your failure to safeguard your credentials.
Acceptable Use
You may not use BenchmarkHQ to scrape, republish, or create derivative commercial products from our content. One account per person — sharing credentials is prohibited. You agree not to use the service for any unlawful purpose or in any way that violates these Terms.
Service Availability and Modifications
We may modify, improve, or discontinue features of the service from time to time. Where reasonably practicable, we will provide advance notice of material changes that adversely affect current subscribers. We do not guarantee uninterrupted or error-free service.
Termination
We may suspend or terminate accounts that materially violate these Terms. Where reasonably practicable, we will provide notice and an opportunity to cure before termination, except where immediate action is reasonably necessary for fraud, abuse, security issues, nonpayment, or legal compliance. You may close your account at any time by emailing support@benchmarkhqdata.com or by using available account tools. Termination does not create a right to a refund except as stated in the Refund Policy above or as required by applicable law.
Disclaimer of Warranties and Limitation of Liability
To the maximum extent permitted by law, the service is provided "as is" and "as available" without warranties of any kind, express or implied. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
To the maximum extent permitted by law, BenchmarkHQ and Dynakai Industries LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the service. To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to the service will not exceed the amount you paid for the service during the 12 months preceding the event giving rise to the claim.
Governing Law and Venue
Except as otherwise required by applicable law, these Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute that is not subject to a separate valid written arbitration agreement will be brought exclusively in the state or federal courts located in Delaware, and each party consents to that forum. Nothing in these Terms limits non-waivable rights or remedies available under applicable law.
